Land Trust Agreement

Mr. Hughes,

      I brought your Basic and Advance Land Trust course back in 2008. When I first started making Land Trusts I didn’t get all of my Land Trust Agreements notarized.  Now I want to sell a few properties  and the attorney is asking to see the Agreements. Is that going to be a problem???? Does the Land Trust Agreement have to be notarized and if so can I get the documents notarized now being that I formed them in 2008.

YES, THE TRUST AGREEMENTS SHOULD BE NOTARIZED TO PROVE THEIR VALIDITY AS OF THE DATE OF THE TRUST. IT WOULD BE BEST IF YOU COULD FIND A NOTARY TO NOTARIZE THE TRUST AGREEMENT AS OF THE DATE OF THE TRUST. OTHERWISE TRY IT WITHOUT THE NOTARY AND SEE IF ANYONE EVEN NOTICES. BY THE WAY, WHICH ATTORNEY IS ASKING TO SEE THE TRUST AGREEMENT...YOURS OR THE BUYER'S??

Dear New Investor,

One of our advisers to this Discussion Forum added the following comment:

"The Grant Deed should have been notarized prior to recording, maybe this would satisfy the attorney."  

I AGREE THAT THIS SHOULD HELP SATISFY THE ATTORNEY.
