What forms I need to complete and give to Title company ?

Sunday, August 15 2010 05:20 PM

Hi,
I am new to this Land Trust. I have read your basis and advanced programs. I wanted to know what forms or documents I need to give to the Title company. I don't think I need to give them the Land Trust agreement.

Do I need to give the "DEED TO TRUSTEE" form to the Title company.

Please advise

Thanks,

Gedu,

PLEASE SEE MY COMMENTS BELOW IN BOLD.

Do I need to give the "DEED TO TRUSTEE" form to the Title company. POSSIBLY, IT DEPENDS ON WHAT YOU ARE TRYING TO ACCOMPLISH. GENERALLY, ALL YOU HAVE TO DO IS RECORD THE DEED TO TRUSTEE AND THEN THE TITLE COMPANY WILL SEE IT WHEN THEY DO THEIR "SEARCH." THE TITLE COMPANY SHOULD NOT NEED YOU TO BRING THEM OR SHOW THEM THE DEED AS THEY WILL ACCESS TO THE DEED ONCE IT IS RECORDED.

Hi Randy,

Thanks for your prompt reply. Actually this is a new home I am buying in the name of land trust. I have some follow-up questions -

1. Where and how should I record the "DEED TO TRUSTEE" ?

2. I got this email from the Title company ---- "I need to get a copy of your trust as quickly as possible so that my underwriter can review it and approve"

What forms or document I need to give them ?.

Thanks,

1. Where and how should I record the "DEED TO TRUSTEE" ?

YOU RECORD THE DEED AT THE "RECORDER OF DEEDS" OFFICE LOCATED AT YOUR COUNTY COURT HOUSE. THAT IS...THE COUNTY IN WHICH THE PROPERTY IS LOCATED.

2. I got this email from the Title company ---- "I need to get a copy of your trust as quickly as possible so that my underwriter can review it and approve"

What forms or document I need to give them ?.IF THE TITLE COMPANY IS SAYING THAT THEY WILL NOT INSURE THE TITLE WITHOUT SEEING A COPY OF YOUR TRUST AGREEMENT, THEN YOU MIGHT HAVE TO SHOW IT TO THEM. TAKE IT IN AND SHOW IT BUT TRY NOT TO LET THEM HAVE A COPY OF THE T.A.
