Naming your Land Trust

Sunday, January 17 2010 10:28 PM

Why shouldn't I name my land trust my property's address?
I was listening to another land trust guru (aka "Mr. Brown") and he mentioned that you should just name your land trust the same as your property address since you're going to have 1 land trust per property anyway.

Dont know what was said on your call with Mr. Brown, but Randy and I believe one of the best starts to PRIVACY is to take away all the clues to ownership.
When someone is surfing the public records ( which is done all the time) if you use the real property address as the name of your land trust you make it easier for someone to put you and your property together. By using a name that doesnt relate to you or your family, you start the process of Privacy and lead yourself towards the goal of Asset Protection.
You work hard to create your real estate assets. Keep your wealth as private as possible. Using the address of the property to name the land trust could lead an adversary right to your property address.  In this day and age that could be a disaster on many fronts.

The naming of Trust along with so many others things you do when putting a trust together is usually not thought to much about, just use the property address.

However, Jim is correct and you should not name the trust with the property address.  We have seen many trusts over the past ten years and the majority of them have been named in this manner.  Every once in awhile a Trust will have a unique name and not be connected in any manner with the property or owner.

I would recommend you use a name that means something to you.  Such as a favorite location or some such name.  This will make it all the more difficult for an investigator to trace it back to you.

You have no idea what occurs when you are involved in litigation and the last thing you should do is provide any leads or assistance to the investigator.
