Filing the Deed in Trust
Thursday, August 13 2009 11:50 AM
I am in SC and acting as a Trustee for a NC resident who owns property in Ohio. We have formed the trust agreement, and now need to file the Deed of Trust in Ohio. Q#1 - Do I have to travel to OH to do this or can it be mailed in? Q#2 - Do the laws on this differ from state to state? Q#3 - What is the filing fee and does it differ from state to state?

By 'filing' I mean 'recording.'

I am in SC and acting as a Trustee for a NC resident who owns property in Ohio. WHERE IS THE SITUS OF THE TRUST? OHIO, SC, OR ANOTHER STATE? We have formed the trust agreement, and now need to file the Deed of Trust in Ohio.
Q#1 - Do I have to travel to OH to do this or can it be mailed in? YES, YOU CAN MAIL IT IN BUT I WOULD CONTACT THE RECORDERS OFFICE OVER THE PHONE AND SEE EXACTLY WHAT LANGUAGE YOU NEED IN THE DEED TO MAKE SURE IT IS EXEMPT FROM TRANSFER TAXES.
Q#2 - Do the laws on this differ from state to state? YES, ACTUALLY EACH COUNTY HAS ITS OWN "QUARKS" WHEN IT COMES TO THE FORM AND WHAT THEY REQUIRE.
Q#3 - What is the filing fee and does it differ from state to state? IN MY COUNTY IT IS 18.00 PER PAGE...EACH COUNTY DIFFERS.
