And/Or Assigns

Thursday, February 26 2009 11:18 PM

I make a lot of offers on REO properties.  Per the basic training, the contract should read "name and/or assigns" so the property can be placed in a Land Trust without being transferred from the buyer.
However, banks (sellers) are refusing to acknowledge the "and/or assigns".  I'm looking for help with this, or information that would provide good ammunition if I attempt to hold my ground.  I'm in Oklahoma.

Gary,

I do not know about OK, but in Illinois you can assign any contrat that does not specifically state that you cannot. In other words, it does not matter if you put "and assigns" on our contracts or not...you can still assign them. YOu might ck. OK law on this.
