Transferring LLC into a land trust

Saturday, July 19 2008 10:00 AM

Right now, I have the property under the LLC. I  am considering  the option of either moving LLC into the trust or take this property off LLC and move into Land trust. Is there any advantage of keeping LLC under the circumstances? Am I wrong in thinking Trust gives me more flexiblity and benefits and give the asset protection like LLC?

Victor,

There is a place for each entity. Start with the Land Trust first then, make the beneficiary of the Land Trust your LLC. However, if you own more than one property you will need multiple LLC's or a series LLC.

Victor,

You would be well advised to invest in our LAND TRUST MADE SIMPLE -Basic home study course. Which gives you all the answers you need about the daily use of land trusts for real estate investors.

Randy and I have received raved reviews about our land trust home study courses.  We teach you what is a land trust, how to use land trusts, provide the forms needed to administer your land trusts in our Basic Course.  Then after you master the basic course you can dive into the Advance home study course and learn STRATEGIES using land trusts and entities.

Randy, you said, "... if you own more than one property you will need multiple LLC's or a series LLC."  Does that mean that one LLC cannot be beneficiary of multiple properties within one trust or mulitiple properties within multiple trusts?

NO, IT JUST MEANS THAT IF YOU HAVE A SINGLE LLC AS THE BENEFICIARY OF MULTIPLE LAND TRUSTS, IT IS A NEXUS FOR A LAWSUIT. THE SERIES LLC IS SUPPOSED TO PREVENT THIS EXPOSURE, BUT TO MY KNOWLEDGE HAS NOT BEEN TESTED IN COURT AT THE APPELLATE LEVEL TO CONFIRM ITS INTENT
