Eviction Process

Hi,
  I have a question about eviction. First I have two LLC?s one is my Property Management Company and the other LLC is the beneficiary of the Land Trust. My lease reads something like this

This Lease agreement made this 10th day of  May 2007, by 123 Main Street Land Trust hereinafter referred to as (Landlord) and  John Doe hereinafter referred to as (Tenant) for Rental of the premises located at 123 Main Street, any town, NY.

The Property Management Company for the above property is Any old Group, LLC hereinafter referred to as (Property Management Company).

Who would file for eviction of the tenants the Landlord or Property Management Company?

It depends on your "local custom" at your court house. For example, in my county i would file under the name of the property management firm as the "agent" for the trust. But your county may do things differently. Either call an attorney that specializes in this or call your local county clerk's office for advice.
