Lenders Wanted

My husband and I are getting into real estate investing and are looking for investors in the Rockford, IL area. I have found great deals and just need the cash flow to start. Hi Traci,

Just remember to make sure you use the money you get as a mortgage and not an opportunity to co-invest as the latter will sebject you to SEC laws.

Someone can give a private money mortgage. If they are investing with you in many cases you are selling securities without a licence.

If you are not sure how to structure these transactions, make sure to talk to an attorney.

In addition to Marty's advice below, DO NOT BECOME A PARTNER WITH ANYONE! The liability is not worth the risk. If necessary you could put the property into a Land Trust and then each of the investors form a personal property trust to be the co-beneficiaries of the Land Trust. This will protect you from personal co-beneficiary liability.

Regarding the Securities Laws Marty talked about, you could sell the investor an OPTION to buy the property you are investing in. Then, the investor could exercise his option and gain his profits that way OR sell the option back to you for his profit. I believe this would keep you out of the securities law issue.
