Return of damage deposit

I have a tenant that renewed a lease in February 2007, with a damage deposit carried over from the original lease. Three weeks ago the tenant notified me that she was breaking the lease and moving out at the end of July. The rent is current. Normal wear and tear in the house.
Should I return the deposit, or should the tenant forfeit the deposit since she broke the lease?

Randy,

It depends on what your lease states. If it states that the tenant will lose their deposit if they terminate early then, YES. Otherwise, if your lease does not specifically state this clause then, it is open to interpretation by a judge. Learn from this experience and make sure this clause is in your lease from now on!
