Think About This Land Trust Idea!
Using a Land Trust with its situs in your state is not always the best idea. Most states do not even have a Land Trust Statute (only six states have actual Land Trust Statutes), but they do recognize the
validity of a Land Trust. What this means is that you could form a Land Trust in one of the six states with a Land Trust Statute to hold title to property in another state.
Not All Land Trusts Are Created Equal!
As mentioned above most states do not even have Land Trust Statute laws on the books, only case law supporting the use of Land Trusts from other states. As like the founding fathers intended, Land Trusts have been left to each state to develop how to rule on the use of them. There is no Federal Land Trust law.
Can I Use Other State's Land Trusts In My State?
As stated above, most all states support the use of Land Trusts (in one form or another) from other states with Land Trust Statute Law. This is generally true in every state, even if they have law on land trusts in that state. Louisiana is one exception. Louisiana does not follow old English Common Law (like all the other states), but still follow French Civil Law.
